Eligibility Age Requirement: You must be at least 18 years old to use our services. By using the platform, you represent and warrant that you meet this age requirement. Minors: If you are under 18, you may use the platform only under the supervision and consent of a parent or legal guardian, who agrees to be bound by these Terms. International Users: TourTime is accessible worldwide. Regardless of your country of residence, you agree to comply with all local laws applicable to your use of the platform. B. User Conduct Compliance with Laws: You agree to comply with all applicable local, national, and international laws and regulations when using the platform. Prohibited Activities: You may not: Use the platform for any unlawful, fraudulent, or malicious purposes. Upload, post, or transmit any content that is defamatory, obscene, pornographic, abusive, or invasive of privacy. Engage in any activity that could damage, disable, overburden, or impair the functioning of the platform. Attempt to gain unauthorized access to any part of the platform, other users' accounts, or any systems or networks connected to the platform. Use any robot, spider, scraper, or other automated means to access the platform for any purpose without our express written permission. User Content: Any content you upload or post on the platform must not infringe on any third-party rights, including intellectual property rights, privacy rights, or any other rights. C. General Rules TourTime Policies: Users must adhere to all TourTime policies, guidelines, and instructions when using the platform. Service Provider Rules: Service providers may have specific rules and policies governing their services. Users are responsible for reviewing and complying with these rules when engaging with a service provider. Violation Consequences: Failure to comply with TourTime's or service providers' rules may result in suspension or termination of your account and access to the platform, without refund or compensation. **Services** A. Booking Activities Intermediary Role: TourTime acts solely as an intermediary platform connecting users with third-party service providers. We do not own, operate, or control the services offered by these providers. Service Accuracy: While we strive to ensure the accuracy of service descriptions, we do not guarantee that all content is error-free or complete. User Responsibility: Users should carefully review all service details, including availability, pricing, and provider-specific rules before booking. International Considerations: Users booking services outside their country of residence are responsible for understanding and complying with international travel requirements, including passports, visas, customs, health regulations, and laws of the destination country. B. Cancellations and Refund Policy General Cancellation Policy Service Provider Policies: Cancellation policies are set by each service provider and will be displayed before confirming the booking. These policies may vary between providers and may be subject to local laws. Cancellation Process: To cancel a booking, users must follow the instructions provided in their booking confirmation or on the platform. Deadlines: Users must adhere to the cancellation deadlines specified by the service provider to avoid cancellation fees or forfeiture of payments. Refund Policy Eligibility: Refund eligibility and amounts are determined by the service provider's cancellation and refund policies, which may be influenced by local regulations. Processing Time: Refunds will be processed through the original method of payment within a reasonable timeframe, subject to the policies of your bank or payment provider. Fees and Charges: Users are responsible for any fees associated with the refund process, including currency conversion fees or bank charges. Non-Refundable Services: Certain services may be marked as non-refundable. In such cases, no refunds will be issued upon cancellation. Force Majeure Unforeseen Events: TourTime and service providers are not liable for cancellations or changes due to events beyond their control, such as natural disasters, pandemics, government actions, or other emergencies. Rescheduling: In such events, service providers may offer alternative dates or services but are not obligated to provide refunds unless specified in their policies. **Accounts** A. Account Creation Registration Information: When creating an account, you must provide accurate, current, and complete information as prompted by the registration process. Updates: You agree to promptly update your account information to keep it accurate and complete. One Account Per User: You may not create multiple accounts or impersonate any person or entity. International Users: By creating an account, international users consent to the transfer and processing of their data in the KSA, in compliance with our Privacy Policy. B. Account Security Confidentiality: You are responsible for maintaining the confidentiality of your account credentials, including your username and password. Unauthorized Access: You agree to notify us immediately of any unauthorized use of your account or any other security breaches. Liability: TourTime is not liable for any loss or damage arising from your failure to protect your account information. C. Account Termination User-Initiated Termination: You may terminate your account at any time by following the instructions on the platform. TourTime-Initiated Termination: We reserve the right to suspend or terminate your account for any reason, including violation of these Terms or inactivity, without prior notice. **Payments** Accuracy: All payment information provided must be accurate, complete, and current. Payment Processing: Payments are processed through secure third-party payment gateways. We do not store your payment information on our servers. Authorization: By providing payment information, you authorize us to charge the designated payment method for the total amount of your booking. Taxes and Fees: Prices displayed may not include applicable taxes, fees, or charges, which may vary depending on the country and local regulations. Users are responsible for all taxes and fees associated with their bookings. Currency: Transactions may be processed in different currencies. Users are responsible for any currency conversion fees imposed by their payment provider. Payment Issues: TourTime is not liable for any delays, errors, or losses caused by payment providers or financial institutions. **Media Utilization** Consent to Use Media: By participating in activities booked through TourTime, you grant TourTime and the service providers the right to use any photographs, videos, or other media in which you may appear, taken during these activities, for promotional, marketing, or any other lawful purposes without compensation, in any country. Release of Rights: You waive any rights of privacy, publicity, or any other rights of a similar nature in connection with the use of such media. Opt-Out: If you do not wish to be included in any media, you must inform the service provider and TourTime in writing prior to the commencement of the activity. User Restrictions: Users may not use, reproduce, distribute, or exploit any media from the platform or activities without prior written consent from TourTime and the respective service providers. **Intellectual Property and Copyright** Ownership: All content on the platform, including but not limited to text, images, graphics, logos, trademarks, and software, is the exclusive property of TourTime or its licensors and is protected by international copyright, trademark, patent, and other intellectual property laws. Limited License: TourTime grants you a limited, non-exclusive, non-transferable license to access and use the platform for personal, non-commercial purposes in accordance with these Terms. Restrictions: You may not: Copy, reproduce, modify, distribute, transmit, display, perform, or create derivative works from any content on the platform without prior written permission from TourTime. Use any content for commercial purposes or in any manner that may infringe upon the rights of TourTime or any third party. Reporting Infringements: If you believe that any content on the platform infringes your intellectual property rights, please notify us immediately with detailed information. **Disclaimers and Limitation of Liability** "As Is" Basis: The platform and all services are provided on an "as is" and "as available" basis without any warranties of any kind, express or implied. No Warranty: TourTime disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and accuracy. Third-Party Services: We do not warrant or assume responsibility for any product or service advertised or offered by a third party through the platform. Limitation of Liability: To the fullest extent permitted by law, TourTime shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to loss of profits, data, goodwill, or other intangible losses resulting from: Your use or inability to use the platform. Any unauthorized access to or alteration of your transmissions or data. Statements or conduct of any third party on the platform. Any other matter relating to the platform or services. Jurisdictional Limitations: Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law. **Indemnification** User Agreement: You agree to indemnify, defend, and hold harmless TourTime, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: Your use of the platform or services. Your violation of these Terms. Your violation of any rights of a third party, including intellectual property or privacy rights. Any content you post or share on the platform. **Dispute Resolution** Governing Law: These Terms are governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia, without regard to its conflict of law principles. Jurisdiction: Any disputes arising out of or relating to these Terms or the use of the platform shall be subject to the exclusive jurisdiction of the courts of Saudi Arabia. International Considerations: Users accessing the platform from outside the KSA are responsible for compliance with all local laws. TourTime makes no representation that the platform is appropriate or available for use in other locations. Arbitration: At TourTime's sole discretion, we may require you to submit any disputes to final and binding arbitration under the Rules of Arbitration of the International Chamber of Commerce. **Termination** Rights Upon Termination: Upon termination of your account or access to the platform, all rights and licenses granted to you will immediately cease. Survival of Terms: All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property rights, disclaimers, indemnity, and limitations of liability. **Severability** Invalid Provisions: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions. **Waiver** No Waiver: The failure of TourTime to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. **Changes to Terms** Notification: We will notify users of significant changes to these Terms by posting a notice on the platform or by other appropriate means. User Responsibility: It is your responsibility to review these Terms periodically for any updates or changes. **Privacy** Data Protection: TourTime is committed to protecting your privacy. Please review our Privacy Policy to understand how we collect, use, and safeguard your personal information. International Data Transfer: By using the platform, you consent to the transfer, storage, and processing of your information in the KSA and other countries, which may have different data protection laws than your country of residence. **Language** Translation: These Terms may be translated into other languages for your convenience. الالتزام بجميع القوانين واللوائح المحلية والوطنية والدولية المعمول بها عند استخدام المنصة. الأنشطة المحظورة: لا يجوز لك: استخدام المنصة لأي أغراض غير قانونية أو احتيالية أو خبيثة. تحميل أو نشر أو نقل أي محتوى يكون تشهيريًا أو فاحشًا أو إباحيًا أو مسيئًا أو ينتهك الخصوصية. الانخراط في أي نشاط قد يتسبب في ضرر أو تعطيل أو إثقال أو إضعاف عمل المنصة. محاولة الوصول غير المصرح به إلى أي جزء من المنصة أو حسابات المستخدمين الآخرين أو أي أنظمة أو شبكات متصلة بالمنصة. استخدام أي روبوت أو عنكبوت أو أداة جمع معلومات أو وسائل آلية أخرى للوصول إلى المنصة لأي غرض دون إذن كتابي صريح منا. محتوى المستخدم: يجب ألا ينتهك أي محتوى تقوم بتحميله أو نشره على المنصة حقوق أي طرف ثالث، بما في ذلك حقوق الملكية الفكرية وحقوق الخصوصية أو أي حقوق أخرى. ج. القواعد العامة سياسات تورتايم: يجب على المستخدمين الالتزام بجميع سياسات وإرشادات وتعليمات تورتايم عند استخدام المنصة. قواعد مقدمي الخدمة: قد يكون لدى مقدمي الخدمات قواعد وسياسات محددة تحكم خدماتهم. يتحمل المستخدمون مسؤولية مراجعة والامتثال لهذه القواعد عند التعامل مع مقدم الخدمة. عواقب الانتهاك: قد يؤدي عدم الامتثال لقواعد تورتايم أو مقدمي الخدمات إلى تعليق أو إنهاء حسابك والوصول إلى المنصة دون استرداد أو تعويض. **الخدمات** أ. حجز الأنشطة دور الوسيط: تعمل تورتايم كمنصة وسيطة تربط المستخدمين بمقدمي خدمات الطرف الثالث. نحن لا نمتلك أو ندير أو نتحكم في الخدمات التي يقدمها هؤلاء المزودون. دقة الخدمة: بينما نسعى لضمان دقة أوصاف الخدمات، لا نضمن أن جميع المحتويات خالية من الأخطاء أو كاملة. مسؤولية المستخدم: يجب على المستخدمين مراجعة جميع تفاصيل الخدمة بعناية، بما في ذلك التوفر والأسعار وقواعد المزود قبل الحجز. الاعتبارات الدولية: يتحمل المستخدمون الذين يحجزون خدمات خارج بلد إقامتهم مسؤولية فهم والامتثال لمتطلبات السفر الدولية، بما في ذلك جوازات السفر والتأشيرات والجمارك واللوائح الصحية وقوانين البلد الوجهة. ب. سياسة الإلغاء والاسترداد سياسة الإلغاء العامة سياسات مزود الخدمة: يتم تحديد سياسات الإلغاء من قبل كل مزود خدمة وسيتم عرضها قبل تأكيد الحجز. قد تختلف هذه السياسات بين المزودين وقد تكون خاضعة للقوانين المحلية. عملية الإلغاء: لإلغاء حجز، يجب على المستخدمين اتباع التعليمات المقدمة في تأكيد الحجز أو على المنصة. المواعيد النهائية: يجب على المستخدمين الالتزام بالمواعيد النهائية للإلغاء المحددة من قبل مزود الخدمة لتجنب رسوم الإلغاء أو فقدان المدفوعات. سياسة الاسترداد الأهلية: يتم تحديد أهلية الاسترداد والمبالغ من خلال سياسات الإلغاء والاسترداد الخاصة بمزود الخدمة، والتي قد تتأثر باللوائح المحلية. وقت المعالجة: سيتم معالجة المبالغ المستردة من خلال طريقة الدفع الأصلية في إطار زمني معقول، وفقًا لسياسات البنك أو مزود الدفع الخاص بك. الرسوم والمصاريف: يتحمل المستخدمون أي رسوم مرتبطة بعملية الاسترداد، بما في ذلك رسوم تحويل العملة أو رسوم البنك. الخدمات غير القابلة للاسترداد: قد يتم تصنيف بعض الخدمات على أنها غير قابلة للاسترداد. في مثل هذه الحالات، لن يتم إصدار أي مبالغ مستردة عند الإلغاء. القوة القاهرة الأحداث غير المتوقعة: لا تتحمل تورتايم ومقدمو الخدمات المسؤولية عن الإلغاءات أو التغييرات بسبب أحداث خارجة عن إرادتهم، مثل الكوارث الطبيعية أو الأوبئة أو الإجراءات الحكومية أو حالات الطوارئ الأخرى. إعادة الجدولة: في مثل هذه الأحداث، قد يقدم مقدمو الخدمات تواريخ أو خدمات بديلة، لكنهم غير ملزمين بتقديم مبالغ مستردة ما لم يتم تحديد ذلك في سياساتهم. **الحسابات** أ. إنشاء الحساب معلومات التسجيل: عند إنشاء حساب، يجب عليك تقديم معلومات دقيقة وحديثة وكاملة كما هو مطلوب في عملية التسجيل. التحديثات: توافق على تحديث معلومات حسابك على الفور للحفاظ على دقتها وكمالها. حساب واحد لكل مستخدم: لا يجوز لك إنشاء حسابات متعددة أو انتحال شخصية أي شخص أو كيان. المستخدمون الدوليون: بإنشاء حساب، يوافق المستخدمون الدوليون على نقل ومعالجة بياناتهم في المملكة العربية السعودية، وفقًا لسياسة الخصوصية الخاصة بنا. ب. أمان الحساب السرية: أنت مسؤول عن الحفاظ على سرية بيانات اعتماد حسابك، بما في ذلك اسم المستخدم وكلمة المرور. الوصول غير المصرح به: توافق على إخطارنا فورًا بأي استخدام غير مصرح به لحسابك أو أي خروقات أمنية أخرى. المسؤولية: لا تتحمل تورتايم أي مسؤولية عن أي خسارة أو ضرر ناتج عن فشلك في حماية معلومات حسابك. ج. إنهاء الحساب الإنهاء من قبل المستخدم: يمكنك إنهاء حسابك في أي وقت باتباع التعليمات على المنصة. الإنهاء من قبل تورتايم: نحتفظ بالحق في تعليق أو إنهاء حسابك لأي سبب، بما في ذلك انتهاك هذه الشروط أو عدم النشاط، دون إشعار مسبق. **المدفوعات** الدقة: يجب أن تكون جميع معلومات الدفع المقدمة دقيقة وكاملة وحديثة. معالجة الدفع: تتم معالجة المدفوعات من خلال بوابات دفع آمنة تابعة لجهات خارجية. لا نقوم بتخزين معلومات الدفع الخاصة بك على خوادمنا. التفويض: بتقديم معلومات الدفع، فإنك تفوضنا بخصم طريقة الدفع المحددة للمبلغ الإجمالي لحجزك. الضرائب والرسوم: قد لا تشمل الأسعار المعروضة الضرائب والرسوم أو المصاريف المطبقة، والتي قد تختلف اعتمادًا على البلد واللوائح المحلية. يتحمل المستخدمون جميع الضرائب والرسوم المرتبطة بحجوزاتهم. العملة: قد تتم معالجة المعاملات بعملات مختلفة. يتحمل المستخدمون أي رسوم تحويل عملة يفرضها مزود الدفع الخاص بهم. مشاكل الدفع: لا تتحمل تورتايم أي مسؤولية عن أي تأخيرات أو أخطاء أو خسائر ناتجة عن مزودي الدفع أو المؤسسات المالية. **استخدام الوسائط** الموافقة على استخدام الوسائط: من خلال المشاركة في الأنشطة المحجوزة عبر تورتايم، فإنك تمنح تورتايم ومقدمي الخدمات الحق في استخدام أي صور فوتوغرافية أو فيديوهات أو وسائل إعلام أخرى قد تظهر فيها، تم التقاطها خلال هذه الأنشطة، لأغراض ترويجية أو تسويقية أو أي أغراض قانونية أخرى دون تعويض، في أي بلد. التنازل عن الحقوق: تتنازل عن أي حقوق للخصوصية أو الدعاية أو أي حقوق أخرى ذات طبيعة مشابهة فيما يتعلق باستخدام هذه الوسائط. الانسحاب: إذا كنت لا ترغب في الظهور في أي وسائط، يجب عليك إبلاغ مزود الخدمة وتورتايم كتابيًا قبل بدء النشاط. قيود المستخدم: لا يجوز للمستخدمين استخدام أو إعادة إنتاج أو توزيع أو استغلال أي وسائط من المنصة أو الأنشطة دون الحصول على موافقة كتابية مسبقة من تورتايم ومقدمي الخدمات المعنيين. **الملكية الفكرية وحقوق الطبع والنشر** الملكية: جميع المحتويات على المنصة، بما في ذلك على سبيل المثال لا الحصر النصوص والصور والرسومات والشعارات والعلامات التجارية والبرامج، هي الملكية الحصرية لتورتايم أو المرخصين لها ومحمية بقوانين حقوق الطبع والنشر والعلامات التجارية وبراءات الاختراع والملكية الفكرية الدولية الأخرى. ترخيص محدود: تمنحك تورتايم ترخيصًا محدودًا وغير حصري وغير قابل للتحويل للوصول إلى واستخدام المنصة لأغراض شخصية وغير تجارية وفقًا لهذه الشروط. القيود: لا يجوز لك: نسخ أو إعادة إنتاج أو تعديل أو توزيع أو نقل أو عرض أو أداء أو إنشاء أعمال مشتقة من أي محتوى على المنصة دون الحصول على إذن كتابي مسبق من تورتايم. استخدام أي محتوى لأغراض تجارية أو بأي طريقة قد تنتهك حقوق تورتايم أو أي طرف ثالث. الإبلاغ عن الانتهاكات: إذا كنت تعتقد أن أي محتوى على المنصة ينتهك حقوق الملكية الفكرية الخاصة بك، يرجى إخطارنا فورًا بمعلومات مفصلة. **إخلاء المسؤولية وتحديد المسؤولية** أساس "كما هي": يتم توفير المنصة وجميع الخدمات على أساس "كما هي" و"كما هي متوفرة" دون أي ضمانات من أي نوع، صريحة أو ضمنية. لا ضمان: تخلي تورتايم مسؤوليتها عن جميع الضمانات، بما في ذلك على سبيل المثال لا الحصر القابلية للتسويق والملاءمة لغرض معين وعدم الانتهاك والدقة. خدمات الطرف الثالث: لا نضمن أو نتحمل مسؤولية أي منتج أو خدمة يتم الإعلان عنها أو تقديمها من قبل طرف ثالث عبر المنصة. تحديد المسؤولية: إلى أقصى حد يسمح به القانون، لن تكون تورتايم مسؤولة عن أي أضرار مباشرة أو غير مباشرة أو عرضية أو خاصة أو تبعية أو نموذجية، بما في ذلك على سبيل المثال لا الحصر خسارة الأرباح أو البيانات أو الشهرة أو الخسائر غير الملموسة الأخرى الناتجة عن: استخدامك أو عدم قدرتك على استخدام المنصة. أي وصول غير مصرح به إلى أو تغيير لرسائلك أو بياناتك. تصريحات أو سلوك أي طرف ثالث على المنصة. أي مسألة أخرى تتعلق بالمنصة أو الخدمات. القيود القضائية: بعض السلطات القضائية لا تسمح باستثناء بعض الضمانات أو تحديد المسؤولية عن الأضرار العرضية أو التبعية. في مثل هذه السلطات القضائية، ستكون مسؤوليتنا محدودة إلى أقصى حد يسمح به القانون. **التعويض** اتفاق المستخدم: توافق على تعويض والدفاع عن وإبقاء تورتايم وشركاتها التابعة ومسؤوليها ومديريها وموظفيها ووكلائها ومرخصيها خالية من أي وجميع المطالبات والمسؤوليات والأضرار والخسائر والتكاليف والمصاريف أو الرسوم (بما في ذلك أتعاب المحاماة المعقولة) الناشئة عن: استخدامك للمنصة أو الخدمات. انتهاكك لهذه الشروط. انتهاكك لأي حقوق لطرف ثالث، بما في ذلك حقوق الملكية الفكرية أو الخصوصية. أي محتوى تنشره أو تشاركه على المنصة. **حل النزاعات** القانون الحاكم: تخضع هذه الشروط وتفسر وفقًا لقوانين المملكة
